JUDGE QUASHES IMPRISONMENT

(New Zealand Press Association) AUCKLAND, Sept. 26. A month’s gaol imposed on Hongi Hika Makara, aged 24, a workman, for negligently driving a truck, was quashed by Mr Justice Shorland in the Auckland Supreme Court today. A fine of £2O was substituted. His Honour confirmed a fiveyear disqualification from driving, and an order that any subsequent licence shpuld be endorsed for three years, but deleted an order that the return of the licence after five years was to be made only after an application to the Court. His Honour said the Magistrate had dealt with the case on the basis that Makara was under the influence of drink, but he had not been charged with that, though the police prosecutor had referred to liquor in outlining the facts.
