Magistrate’s Court £10 FINE FOR DRIVING WHILE DISQUALIFIED
To drive while disqualified amounted to contempt of Court, said Mr N. M. Izard, S.M., in the Magistrates Court yesterday after hearing the case against Karen Willem Adriaens, a 33-year-old woolbuyer (Mr G. H. Gould).
Adriaens pleaded guilty to driving while on a 14-day suspension, this penalty arising fronj a conviction qn~a failjag. to give way. On that occasion, said Mr Gould, Adriaens was also fined £5 and his licence ordered to be endorsed for three years.
The Magistrate fined Adriaens £lO and disqualified him from driving for one month. DANGEROUS DRIVING
For dangerous driving oh Satur-. day night. August 9, John Daniel Rotch, aged 21, a labourer, was fined £2O and his licence suspended for one year when he appeared for sentence. He was fined £5 for assault on a traffic officer and was ordered to make restitution of £5 15s 9d, the cost of the traffic officer’s trousers.
Costs only were imposed on charges of driving while forbidden, giving false information, having no warrant of fithess, and wilful damage.
George William Butler, aged 20, a labourer, Rotch’s companion on the Saturday, was fined £3 on a charge of assault.
Mr A D. Holland appeared for both accused. CHARGE DISMISSED
It would be dangerous to convict, said the Magistrate, dismissing a charge of failing to give way against Glynpe Edward Nagle, aged 26, a builder. Nagle pleaded not guilty. 1 The charge arose out of a col- 1 lision at the intersection of 1 Brougham street and Antigua street between Nagle’s car and 1 a motor-cycle ridden by Graeme Herbert Claridge, a mechanic. Nagle was turning to the right when the collision occurred. It appeared that' Nagle was well oyer the centre of the intersection when the accident occurred, said the Magistrate. It would be dangerous to convict him. OTHER TRAFFIC CASES In other prosecutions brought by the police the following persons were convicted and ordered to' pay costs:— Failing to give way: James Albert Avis. £5: Phillip Collinson Watson, £2; Robert John Whitfield, £3; Jeremiah William Angland, £2; Reginald James Dendle. £2; Graham Rennie Hughes, £lO licence suspended for two months (no driver’s licence, £1); Leslie John Kerry, £3: George Thomas McDowell, £2; Eliza Ann Smith £2; James Alfred Sparkes, £2. Maxwell David Williams, £3. Failing to notify change of ownership: Sydney Joseph Russell Cooper, £1; Lucy Alice Haywood. £l. Driving without due care and attention: Walter Amai. £5; Barry Winstone Richard Burrowes, £5. No warrant of fitness: Ernest Henry Albert Adam, £2; Gordon McDonald Reid, £3. Crossing railway when not clear: Colin James Grenfell, £2. . Insufficient light on cycle: Neil Robin, £l. No driver’s licence: Brian William Glastonbury, £5 (no warrant of fitness, £3). Failing to report an accident: John Charles Wells, £3. DECISION RESERVED Decision was reserved on a charge against the Tai Tapu Central Dairy Company, Ltd. (Mr R. P. Thompson), that on January 21, 1958, the company sold a pound of butter containing a cigarette. Mr P. F. Feenstra appeared for the Department of Health. Mr Feenstra submitted to the Magistrate a number of similar leases against other companies, in which convictions had been
entered. “The facts before the Court show that the onus to take all steps to prevent cigarettes getting in the butter have not been discharged,’’ he said. The company could not search every employee three times a day to ensure they were not carrying cigarettes into the factory. No New Zealander would stand for it. The company had taken all
reasonable steps as .stated by the act, said Mr Thompson. *
“In view of the authorities referred to I will reserve my decision and give it in writing later,’’ the Magistrate said. (Before Mr A. P. Blair, S.M.) CHARGE DISMISSED A charge of driving without due care and attention in Wainoni on July 5 against Norman Mayne-Meighan (Mr H. S. Thomas) was dismissed. On a charge of having no warrant of fitness, Mayne-Meighan was convicted and fined £2. FAILED TO GIVE WAY Gordon Francis Mills (Mr H. W. Thompson) was convicted and fined £2 on a charge of failing to give way. Mills pleaded not guilty. The charge arose from a collision between Mills’s car, which was turning from Blenheim road into Lowe street, and another car coming down from the overhead bridge.
