MAGISTRATE’S COURT
MONDAY (Before Mr Rex C. Abernethy, S.M.) OBSTRUCTED CONSTABLE Lawrence Graham Nicol, aged 23, a truck driver, was fined £lO for obstructipg a police constable on February 15, and £2 for being in possession of illegal lottery tickets. Sergeant E. S. Tuck said that Constable Moloney, when on duty in Cathedral square, saw a number of youths standing on the footpath. When asked by the constable to move, all complied with the exception of the accused. In imposing a fine of £lO, the Magistrate said that Nicol must learn that the streets were for everyone, and they were entitled to use them. He must also learn that hooliganism in the street did not pay. ASSAULT Joseph Cuthers, aged 43, pleaded guilty to a charge of assaulting James Clegg Richardson on February 15. Sergeant Tuck said that the licensee of the • White Hart Hotel found the accused behaving objectionably. When the accused was remonstrated with, he struck Richardson, who held him until the police arrived. The accused had convictions for similar offences. Cuthers was fined £5. APPLICATION GRANTED Permission to remain in New Zealand under section 158 A of the Shipping and Seaman Act, 1952, was granted to John William Harrison, aged 55 (Mr J. G. Rutherford). Harrison deserted from the motor-vessel Port Halifax at New Plymouth on January 8, 1947. OBSCENE EXPOSURE Frederick Claude Hale, aged 25, who appeared for sentence on a charge of obscene exposure, was sentenced to three months’ imprisonment. ■ The Magistrate said it> was a fair assumption that Hale’s mind had become warped, for he had been previously convicted of using obscene language over the telephone. Too much liquor might be one cause of the problem. REMANDED Thomas Rigg, aged 20, and Arnold Noel Nelm, aged 20, were remanded to February 24, when they will be jointly charged on five counts of breaking and entering and theft. Nelm, who is represented by Mr J. G. Leggat. will also be charged with receiving stolen goods, and Rigg will appear on seven charges of theft and breaking and entering and one of a breach of bis probation order. Ernest Alfred Roberts, aged 38, a painter, pleaded guilty to a charge of indecent assault on a male on February 10. He was remanded to February 24 for a Probation Officer’s report and sentence.
On a charge of stealing a leg of lamb, valued at Bs, at Lyttelton on February 7, Patrick James Osborn, aged 27, a workman, was remanded to February 24. Bail was renewed.
Fraser John Richmond, aged 37 (Mr J. G. Rutherford), was remanded to February 20 on a charge of assaulting Allan Victor [Lewis. Bail was allowed in the {sum of £lOO and two sureties of I £75 each. John Denton, aged 30, who was charged with the theft of £3B by failing to account to J. C. Melrose, Ltd., was remanded to Feb- | ruary 24. Bail was allowed in the sum of £5O and one surety of £5O.
