Magistrate’s Court Fines Totalling £300 For Sales Tax Breaches

Fines totalling £3OO were imposed on James Gregg, a wholesaler, in the Magistrate’s Court yesterday on two charges of furnishing incorrect sales tax returns and three of furnishing incorrect returns with intent to defraud. On .the last three charges he was fined £75. £lOO. and £75 respectively. The offences were committed in March. April, and May. The defendant was represented by Mr J. A. Bretherton, and Mr P. T. Mahon appeared for the Collector of Customs. Mr Rex C. Abernethy, S.M., was on the Bench. The total deficiency in sales' tax returns amountpd to £4350 and Gregg was prosecuted in respect of £666. Mr Bretherton submitted that Gregg, who had been in business as a wholesaler for 20 years, was subject to heavy competition in the business in which he was engaged. A lack of method in business was one of the main factors in his failure. Imposing the fine, the Magistrate said the charges were serious and the penalty would have to be severe. REMANDED Patrick Matthew Waring, aged 17, was remanded to November 18 on a charge of unlawfully converting a motor-car, valued at £575. the property of Francis Augustine Geary, on November 12. Bail of £5O. with one surety of £2OO. was allowed. Jeamie Slater Smith, aged 25. a fisherman, as remanded to November 18 on a charge of assaulting Norman Charles Warren. Bail was allowed and the accused was ordered to report to the police daily. DETAINED PENDING DEPORTATION On a charge of remaining in New Zealand after the expiration of a temporary permit. Marine Ahmu. a Samoan, was convicted and ordered to be detained in custody pending deportation. He was charged under the Immigration Restriction Amendment Act, 1952. Mr A. Hearn appeared for the defendent. ADJOURNED A charge against Frederick Arthur Haywood Penfold of using a cap disc to seal milk bottles which was not kept in a sealed sanitary container was adjourned to December 4. The charge was under the Food Hygiene Regulations. A charge nf knowingly applying £213 Is 2d in Social Security charges deducted from the salary or wages of employees for purposes other than payment of the charges. against the Southern Cross Engineering Company Ltd., was adjourned to November 29. COMMITTED FOR SENTENCE Trevor James Garlick, aged 21, pleaded guilty to 10 charges of breaking and entering and theft and was committed for sentence to the Supreme Court. He was not represented by counsel. Senior-Detective J. B. McLean prosecuted. Thirteen witnesses were called by the police, including 10 who were connected with the shops in which breaking and entering and theft had been committed between October 6 and October 23. Evidence was given by three detectives to the effect that Garlick. when interviewed admitted the offences and produced articles which were later identified as the stolen property.
