MAGISTRATE’S COURT
WEDNESDAY (Before Mr F. F. Reid, S.M.) DESERTED FROM SHIP Anthony O’Farrell, aged 30, a seaman, was admitted to probation for two years oh a charge of deserting from the overseas ship Southern Prince at Wellington on May 25. REMANDED Ivan Keith Sutton, aged 18, a workman, was remanded to July 1 on a charge of breaking and entering the shop of John William Ramsden, Riccarton on June 25 and committing theft. INCOME TAX CHARGES Nelm Harvey Chaplin was fined £3 and Raymond Maxwell Gilchrist £4 for failing to make returns of income. FINED £6 Wrights Metropolitan Milk Company, Ltd. (Mr A. C. Perry) was fined £6 for failing adequately to clean a container for pasteurised milk. BUILT WITHOUT PERMIT For erectiong a building without a permit Cashmere Properties, Ltd. (Mr K. J. McMenamin) was fined £5. OCCUPATION NOT AUTHORISED For occupying a building for a purpose not authorised, Christian William Dorias (Mr G. S. Brockett) was fined £l.
(Before Mr W. E. Olds, J.P., and Mr H. T. Fuller, J.P.) COMMITTED FOR TRIAL William Davey, aged 43, a painter, who had elected trial by jury, was charged with attempting to break and enter premises at 95, 95A, 97, and 101 Main North road, occupied by Phillip Jordan Day, Eileen Rose Laurie, Donald William Creegan and Warren Maxwell Holden, with intent to commit theft on May 23.
Evidence was given by Wilfred David Nicholl, a motor mechanic, living at 100 Main North road, who said that he had seen a man who had interfered with doors of shops opposite his place and had disappeared in the direction of the Phoenix Hotel.
Acting-Defective R. H. Mitchell said he had received reports of attempts to break and enter premises on the Main North road where entrance had not been gained. He had next gone to the Phoenix Hotel, 30 or 40 yards away, where he found accused crouched near a motor-car with a screw-driver in his hand. Accused said he had intended to take part of the car. When taken to the Police Station and searched a spanner and fragments of glass were found in Davey’s pockets. The pieces of glass found fitted into a pane taken from one of the premises. Accused was later arrested on a charge of being a rogue and vagabond. Detective-Sergeant T. Thompson said an inspection of premises had shown that damage was consistent with that which might have been done with a screwdriver. When interviewed accused had said he had been short of money at home and had left with the intention of getting some. He had made four statements on his attempts to break and enter which, he said, had not been successful.
Davey pleaded not guilty, reserved his defence and was committed for trial at the Supreme Court.
