DISPUTE OVER WILL
SETTLEMENT SUGGESTED After Mr Justice Henry had suggested to counsel in a disputed will • case in the Supreme Court yesterday that it might be better if they could agree on a settlement, the hearing was adjourned to see if agreement could be reached by the parties. Louise Halliday, a widow (Mr W. G. P. Cunningham), is the plaintiff. The defendants are Elsie Muriel Worthington. a widow. Maurice Anthony Worthington, a labourer, Leonard Edward John Worthington, a labourer (these three being represented by Mr N. G. Hattaway), Mabel Violet Lawrie, a married woman, and Doreen Beatrice McGee, a married woman (both represented by Mr E. J. Somers). Mr G. L. Caldwell appeared for the Public Trustee as executor of the estate of Thomas Halliday, a farmer. Mr Cuningham said that the testator. Thomas Halliday, died on October 12. 1954, leaving an estate of £ll7O. The plaintiff was 74, and her sole income was the age benefit and some assistance from her daughter. Mrs McGee, who lived with her. Mrs Lawrie was the other daughter. Mrs Halliday had brought up the two children by her own efforts. She was deserted by the testator. He was instructed to ask for the whole estate or a lump sum of £5OO at 10s a week. The Worthingtons claimed that the farm of the testator was promised to them. The estate was left to them in equal shares. In reply to a question by his Honour, counsel said there was little chance of them making a working order for approval by the Court. His Honour said they might confer and see if they could reach agreement, and he would adjourn the case. DECREES NISI GRANTED A decree nisi was granted, on the grounds stated, to the petitioner in each of the following undefended petitions for divorce heard before Mr Justice Henry in the Supreme Court yesterday:— Separation.—Patricia Young (Mr D. A. Oldham) v. Colin Craig Young; Mary Elizabeth Warren (Mr C. M. Roper) v. Keith Rawson John Warren; Robert Reynold Lyne (Mr C. M. Roper) v. Daphne Lillian Lyne. Desertion.—Evelyn Pedersen (Mr P. H. T. Alpers) v. Stanley Eric Pedersen.
