APPEAL AGAINST JUDGMENT

CLAIM IN FATHER’S ESTATE

(New Zealand Press Assoctatton) WELLINGTON, October 2.

An appeal under the Family Protection Act relating to the estate of Patrick Brosnahan, of Rosewill, near. Timaru, a farmer, who died in June, 1954, aged 88, was begun in the Court of Appeal today. The appeal was brought by a son, William James Brosnahan, of Christchurch, a salesman, who. in proceedings brought by him in the Supreme Court at Timaru. was awarded from his father’s estate £1250 in lieu of the provision in the will which gave him a legacy of £7OO.

The Supreme Court application was heard before Mr Justice Henry. In the Court of Appeal nearing, counsel for W. J. Brosnahan contended that such provision was inadequate, having regard to the comparative financial position of Brosnahan’s brother, Matthew Vincent Brosnahan, the residuary beneficiary. The hearing is proceeding.
