PROHIBITED AREA FOR CARS
“NO PARKING” SIGNS HELD SUFFICIENT MOTORIST CONVICTED AND FINED Reasonable notice of a no-parking area on the Gloucester street bridge had been given and defendant. Claude Whitney Evans, an accountant, would be convicted on a charge of parking in a prohibited area on August 9, 1954, said Mr L. N. Ritchie. S.M., when he issued a reserved decision in the Magistrate’s Court yesterday. Evans was fined £2 and ordered to pay costs. Chief Patrol Officer P. Lunn prosecuted Evans in the Magistrate’s Court on June 14 after the case had been adjourned a number of times. Evans was represented by Mr A. C. Perry. Defendant parked his car between 8.30 p.m. and 9.45 p.m. on the south side of the bridge between “No Parking; Day or Night” signs, which conformed with the requirements of the regulations, said. the Magistrate. “The defendant says it was a night when visibility was not good and he said that he looked for signs and found none and he presumed his reason for not seeing the sign was that he was dazzled by the light which was beThe regulations did not say that the sign was to be lit or illuminated at night and only said that it had to be erected so to give reasonable notice of the no-parking area, the Magistrate continued. He had visited the scene in company with Messrs Lunn and Perry to see the signs and lights for himself. “The signs as erected did give reasonable notice of the no-parking area.” the magistrate said. “The signs are illuminated by the headlights of approaching vehicles when on depressed beam.”
