GAMING ACT BREACHES

JUDGE FINDS FOR CROWN i COMPETITION ORGANISED BY AUCKLAND BANDS (New Zealand Press Association) AUCKLAND, June 2. A competition for prizes organised last year by the Auckland Bands’ Association was dictated by chance, said Mr Justice Stanton in a written judgment in the Auckland Supreme Court today. In allowing an appeal by the Crown (Mr G. S. R. Meredith) against the dismissal by a Magistrate of charges under the Gaming Act against the association (Mr L. H. Southwick) his Honour said:

“The facts disclose a breach of the section. The case is remitted to the Magistrate’s Court with the direction that- on the facts stated a conviction should be entered, and the matter further dealt with on that basis.” To help the band, Auckland shop-’ keepers gave goods displayed in their windows. At a band concert at Carlaw Park on September 5, pamphlets were distributed to the public, bearing numbers corresponding with those on the goods. Persons receiving pamphlets had to search the shop windows to find the goods corresponding to the numbers of their pamphlets. Though industry was needed to find the actual prizes, said his Honour, only chance could affect the actual distribution of the prizes.
