MAGISTRATE’S COURT Malcolm Smith, who did not appear was charged before Mr Rex C. Abernethy m the Lyttelton Magistrate’s Court yesterday with driving without due care and attention on the Sumner road. Evidence was given that the defendant drove a truck down the Sumner road at an excessive speed, disregarding notices that the road was under repair, and endangering employees of the Ministry of Works. The defendant was convicted and fined £3. George Allan Smith, for allowing cattle to wander on a public road was convicted and fined £3. For parking too near a pedestrian crossing, William Francis Hollis was fined 10s. The Lyttelton Borough Council proceeded against John Alfred Hunter for failing to comply with a notice under the Housing Improvement Act, 1945. The defendant was convicted and fined £3. David Joseph Burke (Mr H. S. Thomas) pleaded not guilty to a charge of taking a dog into a railway carriage of a passenger train. In dismissing the information, the Magistrate said there was some doubt whether the defendant had travelled with the dog in a carriage.
