CONVICTION FOR FRAUD
DECISION RESERVED ON APPEAL (New Zealand Press Association) WELLINGTON, September 14. „An appeal by Jasper Antony Harland Holt Waring, a Hastings signwriter, on a charge of obtaining credit fradulently was heard by the Court of Anpeal yesterday. Waring was charged in the Supreme Court at Napier with the theft of a motor-car which he was buying under hire-purchase agreement from Ross, Dysart, and McLean, Ltd., Hastings motor-car dealers, by selling the car to James William Porter, trading at Petone as Fairway Car Sales. He was also charged with obtaining credit fraudulently from Fairway Car Sales m respect of the transaction. Waring was acquitted on the charge of theft, but was convicted of obtaining credit fraudulently, and was senmonths’ imprisonment. u r -2' f'’, D SS ole ’ counsel for Waring, submitted that, because of the acquittal on the first count, there was no evito support the second count. The Court, comprising Mr Justice Stanton, Mr Justice Hutchison, and Mr Justice McGregor, reserved its decision. Mr W. H. Cunningham appeared for the Crown.
