LICENCES SUSPENDED FOR TRAFFIC BREACHES

Ross Darragh Levy was fined £5 and his driver’s licence was suspended for three months, when he was convicted in the Magistrate’s Court yesterday on a charge that he drove a vehicle in a manner which might have been dangerous to the public. Levy, who was represented by Mr W. K. L. Dougall, pleaded guilty to the charge. Mr Raymond Ferner, SJI., was on the Bench. Chief Patrol Officer P. Lunn said that during the evening of June 6 two patrol officers in Linwood avenue saw a car travelling fast along the avenue. The officers checked defendant over the Worcester street intersection at a speed they estimated at 40 miles an hour. They gave chase, and at one stage reached 55 miles an hour without catching up with defendant. The chase was carried on around Avonside drive to the Swanns road bridge, into Eveleyn Couzins avenue and Flesher avenue, where defendant stopped. During the chase defendant switched oft his lights on two occasions. The officers had used the siren in an attempt to stop defendant during the one mile and a half chase. His speed over this distance alternated between 40 and 50 miles an hour. “This speed on such roads, coupled with the fact that he drove with his lights switched off on two occasions, on each of which he travelled for about two chains, was very dangerous,” said Mr Lunn. Mr Dougall said defendant admitted driving at 40 miles an hour along Linwood avenue. He said that he had seen the lights of a car behind him and had attempted to shake it off. His reason for wishing to do this was that on one other occasion while riding a bicycle along the avenue, a car. had driven up behind him, and he was accosted by a man. He ha’d put his lights off in the hope that the following car would lose him. Allen Rhodes, who pleaded guilty , to a similar charge, was fined £5 and his driver’s licence was suspended for 28 days. •

Traffic Officer R. A. Gallagher, of the Transport Department, said that on June 12 he saw a heavy vehicle travel past St. Bede’s College, a restricted area, at between 40 and 50 miles an hour. He gave chase, and he checked the vehicle at 40 miles an hour while it was travelling towards the Papanui shopping area. It was dark at the time and he considered that, havipg regard to his speed, defendant was driving in a dangerous manner.

A fine of £5 was imposed on Richard James Trott, who was convicted on a similar charge. His licence was suspended for three months, and the Magistrate ordered that the conviction be endorsed on his licence. Traffic Officer A. Goldsmith, of the Transport Department, said that about 5.15 p.m. on June 29 he noticed a car travelling north along the Main South road at a fast pace. He gave chase, and found the defendant’s speed was 40 miles an hour. On reaching Hansons lane defendant swung out on to his Incorrect side ot the road for some unknown reason, and later he overtook traffic on two occasions, forcing oncoming traffic into the kerb. A charge against John Charles Witherington, of speeding on Riccarton avenue in a Transport Board bus, was dismissed. Mr R. E. Wylie appeared for defendant. CIVIL CASES (Before Mr L. N. Ritchie. S.M.) CLAIM FOR DAMAGES SUCCEEDS Judgment for the plaintiff, Clifford Douglas Wright, a mechanic (Mr R. Twyneham), was entered against Noble David Morton, a taxi proprietor (Mr E. S. Bowie), in a claim for damages arising out of an accident. Wright, in his statement of claim, alleged that on or about September 12 last year he was driving along Oxford terrace when his car was involved in a collision with a car driven by defendant at the intersection of Oxford terrace, Cashel street, and Durham street. He claimed that the accident was due t<r the negligence of the defendant’s servant and sought £37 15s damages for repairs to his car and £5 for depreciation on his vehicle. The defendant, in his counter-claim, denied that the accident was caused by his servant and alleged negligence on the part of the plaintiff. He counter-claimed for £35 3s 6d as repairs to his taxi and £45 10s for the loss of his car while it was undergoing repairs. Judgment for the plaintiff, with costs, was entered in the sum of £37 15s.
