GAMING CHARGES DISMISSED

PUBLICATION OF RACING TIPS (New Zealand Press Association) AUCKLAND, July 16. Gaming charges brought in the Auckland Magistrate’s Court last week against the publisher and printer of a racing publication were dismissed in a reserved judgment delivered by Mr H. Jenner Wily, S.M., today. The publication concerned is the “Race Recorder,” purporting to give a guide or tip to doubles investments. It is published by George Frederick Munday, a foundry worker, and printTed by Printing Service. Ltd. The police contended that two June issues were “notifications” giving information or advice as to probable results, in contravention of the Gaming Amendment Act, 1949. The Magistrate ruled in favour of the defence that the publication was a newspaper, even though unregistered at the time of the alleged offences, and was therefore exempted under the Gaming Amednment Act.
