MAGISTRATE’S COURT

FRIDAY (Before Mr Rex C. Abernethy, S.M.) REMANDED Mary Emma Blair, aged 59, a domestic (Mr E. M. Hay), was remanded in custody to February 19* on a charge that, with intent to procure a miscarriage of a woman, she unlawfully used an instrument. When asking for the remand, DetectiveSergeant E. G. Ward said he had been instructed to oppose bail. The accused had been arrested on January 28 on a similar charge and had been granted bail. The present offence, he said, had been committed while on bail. The woman concerned in the offence had been in hospital, but she had since been discharged. Mr Hay sought bail on the grounds that the accused was a diabetic and he did not think the prison authorities would be able to provide the special diet she needed. She was in very bad health, he said.

After a discussion in chambers with Mr Hay and Detective-Sergeant Ward, the Magistrate said he proposed to refuse bail. Brian Terence Daley, of Halswell, aged 31, a bagmaker (Mr H. S. Thomas), was remanded to February 19 on charges that, on February 12, while under the influence of drink to such an extent as to be incapable of having proper control of a motor-vehicle, he was in charge of a station waggon in Fendalton road, and that on the same day, while in a state of intoxication, he was in charge of a station waggon and by an act or omission thereto, caused the death of Ethyle Sewell. Bail in the sum of £5O, and one surety of £l5O, was allowed.

Keith de Lisle Tomlinson, aged 30, a fishmonger (Mr H. S. Thomas), was remanded, to February 19 on a charge that on January 14. while under the influence of drink to such an extent as to be incapable of having proper control of a motor-vehicle, he was in charge of a car in Cashel street. Cottrell) was also dismissed.
