MAGISTRATE’S COURT

TUESDAY (Before Mr Rex C. Abernethy, S.M.) REMANDED FOR SENTENCE Tutu Papawai Nihoniho, aged 17, a labourer, of Rangiora (Mr K. w. Frampton), pleaded guilty to three charges of unlawful conversion of motor vehicles and was remanded to Friday for a report from the Probation Officer. .Ball was allowed in the sum of £2o,ana one .surety of £lOO, Nihoniho to, report daily tq_the police. -An application for the interim suppression of his name was refusedThe charges were that on May 8, at Christchurch, Nihoniho converted a motor-cycle valued at £l6O, the property of Martin Donald Stadnyk; that on May 10 at Christchurch he converted a motorcycle valued at £165, the property of Eric Noel Taylor; and that on May 11, at Dunsandel, he converted a motor-truck valued at £l6OO, the property of the Ellesmere Transport Company. Detective-Sergeant G. C. Urquhart, who prosecuted, said that Nihoniho had previr ously been convicted of stealing a motorcycle, Which he had repainted and fitted with new number plates. BREACHES OF PROBATION Peter Hammond Hoss, aged 27, a truck driver, was discharged when, because of breaches of the terms of his probation, he Was brought up again on charges that on September 12 and September 13, at Huntly, he stole seven and a half dozen bottles of beer and three wooden crates, to a total value of £7 5s 6d, the property of the Huntlv Thistle Soccer Club. A Probation Officer, Mr J. Ryley, said thtff Ross had pleaded guilty to the charges in the Huntly Magistrates Court on October 14 and had been admitted to probation for two years, on condition that he make restitution and take out a prohibition order. Since then he had been convicted of being intoxicated in charge of a motor vehicle, of theft, and of breaches of the prohibition order, and he was being brought up under the original charges to have him removed from probation as an undesirable. Ross said that he had made restitution to the Huntly Thistle Soccer Club. “If you come up again on any other serious charge, I’ll deal sharply with ybu, said the Magistrate.

CONVICTION FOR DRUNKENNESS Richard Norman French, aged 50, a labourer, was ordered to be detained for not more than 12 months in the inebriates institution on Roto Roa Island when he appeared on a charge of being found drunk in Kingsley street on May 11, having been convicted of drunkenness four times within the previous six months. French pleaded guilty and asked to be sent to '‘the Island.” Senior-Sergeant C. A. G. Mcßae said that French was an absolute pest as tar as his wife was concerned. He was living apart from her, but when he had taken liquor he went back and made himself a nuisance. PROHIBITED IMMIGRANT Larry Lee Nu Chee, known as Larry Lam, was ordered to be detained in custody and placed on the first available ship to Samoa when he appeared on a charge of remaining in New Zealand after the expiration of a temporary immigration permit. He pleaded not guilty. Mr P. Mahon, who appeared for the Crown, said that the defendant had entered New Zealand in 1945 under the sponsorship of the Department of Island Territories. His temporary permit had been renewed from year to year, until the department had “formed the opinion that it might be better if the defendant was returned to Samoa.” INTERFERENCE WITH CAR A 50-year-old man whose name was ordered to be suppressed in the meantime pleaded guilty to charges that on May 11 at Christchurch he unlawfully interfered with a motor-car, was found drunk in Lichfield street, and was found in possession of documents intended to be used for an illegal lottery. He was remanded until tomorrow for a Probation Officer’s report, bail being allowed in the sum of £2O, with one surety of £2O. Mr D. W. Russell, who appeared for the defendant, said that'the defendant had been to a wedding on May 11 and .had "indulged excessively." He had never been before any Court before, and had just made a complete fool of himself. REMANDED Mervyn Ronald Looms, aged 32 a taxidriver, was remanded to May 19 on a charge of being Intoxicated in charge of a motor-cycle at Christchurch on May 4. Bail was renewed. James Patrick McEwan, aged 21, a farmhand, was remanded to appear in the Wellington Magistrate’s Court today on a charge of having received, from Tony TeWhenui, a binocular valued at £l5 10s, the property of Thomas Edward Williams, knowing it to have been dishonestly obtained.

Riding unlighted cycle at night: Donald George Adams, 20s; John Martin Renner, 20s.

CLAIM FOR ASSAULT Arthur Charles Johns, aged 48, a waterside worker (Mr P. H. T. Alpers) was awarded £1 general damages and £l4 special damages from Arthur Charles Neville, a labourer (Mr J. G. Leggat) and William Edward Richards, a labourer (Mr W. G. P. Cuningham). Johns alleged that Richards and Neville had entered Ills bach early in the morning of April 7 and assaulted him because he had been associating with Neville’s wife. As a result of. the assault he had been in hospital for four days, and was off work for two weeks.

Johns claimed £lOO general damages and £27 special damages. The Magistrate said he was satisfied that Johns had been assaulted by Neville, and that it was a planned expedition.
