TRAINER’S APPLICATION FAILS
(N.Z.P.A. —Reuter—Copyright) SYDNEY, November 3. !n a reserved Equity Court judgment, Mr Justice Roper dismissed a suit brought by a racehorse trainer, Alexander Higgins, a former trainer in India, against the Australian Jockey Club. Higgins had sought an injunction to restrain the club from treating him as a disqualified person. Last August Higgins, who had owned horses in New South Wales, Victoria, and New Zealand, asked the Court to declare hirn not a disqualified person according to the Australian Jockey Club rules. His application was
Mr Justice Roper found that the club had not threatened to treat Higgins as disqualified. The club contended that though it had refused the entry of his horse Mayfowl in a race under a rule which did not require it to give any grounds for rejection, it had never taken action to prevent Higgins from entering the Randwick racecourse.
