APPEAL TO N.Z. CONFERENCE

DISQUALIFICATION TERM (P-A.) WELLINGTON, March 29. An appeal has been made to the New Zealand Racing Conference by Allen Yarndley, of Te Awamutu, a farmer, against the decision of the Auckland District Committee on March 28, confirming the disqualification of 12 months imposed on him for a breach of rule 282 in respect of the running of his horse, Bright Fox, in the Ruakaka Hurdles at Te Aroha on February 26. Yarndley appeals on the following grounds:—(l) That the basis of the finding of the judicial committee of the Te Aroha Jockey Club under rule 282, that he was a party to Bright Fox not being run on its merits in the race, was the fact that he had given evidence stating he was satisfied with the way in which the jockey, Collett, had ridden the horse. (2) That no further or other proof of his being a party to Bright, Fox not being run on its merits in the race was tendered to, or produced, at the hearing before the Auckland District Committee on March 28. (3) That there was not any proof that he was in fact a party to the horse not being run on its merits in the race; and (4) That the penalty of disqualification under rule 282 had been imposed on him without evidence and amounted to a denial of natural justice. The appeal will be heard on April 11.
