RULING GIVEN BY COURT Judgment for the defendant company was given in the Arbitration Court by Mr Justice Tyndall, in a reserved decision on a claim brought by Alfred Charles Barnes, inspector of awards, Christchurch, against Bituminous Roofing Products. Ltd., for an alleged breach of the New Zealand Engine Drivers, Firemen, and Greasers’ (general section) Award. The plaintiff claimed the sum of £lO from the defendant as a penalty for employing D. McMahon, an engine-driver, on Sunday. April 4, without paying him a minimum of eight hours’ pay. and £lO for employing him on Saturday. April 17, with failure to pay a minimum of eight hours’ pay. The action was brought to obtain an interpretation by the Court. “By virtue of clause 2 (b) of the award, the ordinary hours of work of the en-gine-drivers concerned are the same as those fixed by the New Zealand builders’ and labourers’ award." said the decision. “It is clear that their ordinary working hours are spread over five days. Monday to Friday, inclusive, and that Saturday and Sunday for these workers are not ordinary working days. Consequently, work performed by them on Saturdays and Sundays is not subject to the minimum period of eight hours per day or shift prescribed by clause 2 (c) of the engine drivers’ award."
