MAGISTRATE’S COURT Barney Herewini. who pleaded guilty before Mr H. P. Lawry. S.M.. at the Lyttelton Magistrate's Court yesterday to a charge of failing to observe the terms of a probation order, was convicted and sentenced to three months’ imprisonment.
Maurice David Baines, aged 21 years, a railway employee, was charged with false pretences in that he obtained from Frederick Zucker, a dealer, the sum of £l2 by falsely representing that a radio set was his own property and was unencumbered. He pleaded guilty. On condition that he made restituticm of £l2, he was convicted and ordered to come up for sentence if called upon within 18 months. Andrew Brown Rafferty, a waterside worker (Mr A. R. Jacobson), was charged on the information of his wife. Laura Dorothy Rafferty, with having assaulted her on January 4. He pleaded not guilty After hearing the evidence the Magistrate said he was satisfied that the defendant had acted in self-defence. Rafferty had done his best to get away and avoid trouble, but was pursued by his wife.
“In fact.” said the Magistrate, “the wife herself might have been charged with assault. It was a most objectionable form of conduct which she resorted to, and Rafferty was compelled to act in selfdefence. The case will be dismissed.”
