FINE FOR ILLEGAL TRANSACTION PAYMENT IN EXCESS OF FIXED PRICE (P.A.) PALMERSTON N„ Jan. 13. What is believed to be the first prose-' cution in New Zealand under the 1946 amendment of the Servicemen’s Settlement and Land Sales Act, 1943, concluded with a reserved judgment by Mr C. C. Marsack, S.M., in a case in which William John Crawford, a printer, of Palmerston North, was charged with entering into an arrangement for the sale of a property, such arrangement being inconsistent with the Act. The Magistrate imposed a fine of £lOO in addition to the forfeiture to the purchaser of £325, representing excess consideration paid. The police said that the case was based on allegations of “under-table" dealings in the sale of a house to John Henry Simmonds, an officer of the R.N.Z.A.F., involving payment to the accused of £325 in excess of the price approved by the Land Sales Court. The Magistrate commented on the regrettable conflict of evidence, but declared that the evidence of Simmonds, the purchaser, appeared to him to be consistent and truthful. Simmonds was granted a certificate to this effect under Section 3 of the 1945 amendment of the Act.
