RESERVED JUDGMENT GIVEN BY CHIEF JUSTICE A ruling that the Nurses’ Memorial Fund was entitled to the capital sum and any interest that had accrued since the Mary Raymond District Nursing Committee ceased to exist has been made by the Chief Justice (the Rt. Hon. Sir Michael Myers), who reserved judgment after hearing an originating summons for the interpretation of certain clauses in the will of Miss Catherine Julia McLean, formerly of Timaru, whose death occurred in 1927. When the legal argument was heard in the Supreme Court at Timaru on February 4, it was submitted that Miss McLean had bequeathed certain moneys to the Mary Raymond District Nursing Committee, not now in existence, and the point argued was whether the moneys should be paid now to the South Canterbury Hospital Board, which is carrying on the work of the disbanded committee. His Honour thought that the case came within Section 15 of the Religious. Charitable, and Educational Trusts Act, 1908, and should be dealt with under that section, and the following sections of 1 interpretation means that a separ-. ate trust fund will have to be arranged for the distribution of the gift made by Miss McLean. The reserved judgement given by the Chief Justice was delivered by the Registrar of the Supreme Court at Timaru (Mr D C. E. Webster).
