The evidence was not strong, said his Honour, and although the jury might have a strong suspicion that the accused was guilty, it would be dangerous to convict. as mere suspicion was insufficient to warrant a conviction. After a short retirement the jury returned with a verdict of not guilty. When Fisher was later charged with breaking and entering the counting-house of Beath and Company. Ltd., with intent to commit a crime, he pleaded guilty and was remanded for sentence.
