NOTICE is hereby given'that at a Special Meeting of the Council convened for the purpose and held on Tuesday, September 5, 1944, the following resolutions were carried :-rA. THAT pursuant to the provisions of “The Municipal Corporations Act, 1933,'' and 'The Local Bodies Loans Act, 1926,' the Kalapoi Borough Council hereby resolves, so that this resolution may be confirmed at a subsequent meeting of the Council and operate as a Special Order, as follows, that is to say: 1. THAT the said Council hereby re solves to raise a Special Loan of Twenty Thousand Pounds, to be known as the “Housing Loan (No. 4) 1944,” for the purpose of the acquisition of land and the erection of workers’ dwellings and for any other purpose in relation to workers’ dwellings as described In Part XXVII of “The Municipal Corporations Act, 1933." 2. THAT the term of the said loan shall be 20 years and the rate of 'interest on any part of such loan shall not exceed Three Pounds (£3) per centum per annUm. 3. THAT the said loan, or any part thereof, shall be repaid by equal aggregate an nual or half-yearly instalments, extending over the term determined in-paragraph 2 above, and that the payment of such instalments shall be made in New Zealand, and no such instalment shall be paid out of loan money, 4. THAT no amount shall be payable for brokerage, underwriting and procuration fees in respect of the raising of the said loan or any part thereof. 5. THAT no moneys shall be borrowed under this sanction after the expiration of two years from the date of the Order in Council consenting to the loan., 6. THAT the security for the Interest and the repayment of this said loan be a special annually recurring rate of .4473 d (decimal point four four seven three pence) in the Pound (£) on the rateable value (on the basis of the capital value) of all rateable property of the Borough comprising the whole of the Borough of Kaiapol. 7. THAT • the said loan of £20,000 be raised by the issue of debentures under “The Local Bodies Loans Act, 19f16,” and that with respect to each part of such loan for which a separate debenture issue is made each debenture of such issue shall be of the same aggregate sum, comprising an instalment of principal and interest sufficient to repay the whole of such part of the loan with interest thereon at a rate not exceeding three per centum (3 p.c.) per annum upon the expiration of the loan period of twenty years. 8. THAT the ‘ said debentures shall be payable at any branch of the Rank of New Zealand within the Dominion of New Zealand free of exchange to the holder thereof. _ , . „ „ , 9. THAT the Corporate Seal of the Kaiapol Borough Council be affixed to all such debentures and that all such debentures be countersigned by the Mayor and Town Clerk. B. 1. THAT it will not use the said loan or any part thereof for any purpose other than herein specified and in particular will not use any part of the said loan in or towards any building or dwelling which could not reasonably be considered to come within the definition of "workers’ dwelling.’’ , . „ 2. THAT It will not relend the said loan moneys or any part thereof direct to individuals or Invest any part of the said loan provided that this provision shall not operate to prevent the Council taking security for any balance of purchase money remaining owing on the sale of any dwelling erected out of the said loan. 3. THAT it will not at any time during the term of the said loan allow any dwellings built under the proposed scheme to be sold, leased or let to persons with an income exceeding £SOO p.a. unless the Minister of Housing or other Minister for the time being responsible for such limitation agrees to an increase in the "imitation so fixed. , , 4. THAT it will not permit the erection of any dwellings to be proceeded with without having first obtained the approval .of the Department of Housing Construction. , 5. THAT in any contract for sale or lease by the Council of any dwelling erected out of the said loan a special convenant will be embodied providing for the prior consent of the Council to any sale or other disposal of such dwelling, and providing further that such consent be withheld to any proposed sale where the purchase price on the resale is in excess of the original value of the dwelling and section less depreciation plus improvements. . . .. . The Council proposes at a Special Meeting to be held on TUESDAY. 3rd day of October, 1944. to consider and confirm the aforesaid resolutions. Any person having any objections to the proposed application is called upon to submit the same in writing to the Kaianol Boroueh Council not later than the day preceding the said meeting.
