LAND SALES ACT (P.A.) DUNEDIN, May -27. A judgment pf interest to local bodies was given by Mr Justice Kennedy in proceedings brought by the Dunedin City Corporation against the Commissioner of Stamp Duties *on a writ of mandamus. The question at issue ■ was whether a renewal of a “Glasgow lease, which provides the terms for’ renewal is, in respect of that renewal, exempt from the provisions of the Land Sales Act in that it is a renewal of an existing lease and not a fresh lease under the act. If it is a renewal, the act does not apply. In a “Glasgow” lease there are provisions for valuation and the fixing of an upset rental and the subsequent submission of the new lease to public auction. , The defendant in the present case refused to accept the lease in question because he contended it was a new lease requiring the consent of the Land Sales Committee. The contention of the corporation was that, being a renewal,, such a renewal did not require consent.; - , In a Iqm£.judgment, his Honour held that of a “Glasgow” lease did not cpme within part 14 of the Servicemen's Settlement and Land Sales Act, 1943, and therefore the consent of the Land Sales Committee was hot required. ->
