MAGISTRATE'S COURT
♦ WEDNESDAY (Before Mr G. G. Chisholm, S.M.) GROCER CHARGED T. C. Tyson and Son, grocers, were fined 10s and ordered to pay costs on a charge—brought under the Weights and Measures Amendment Act, 1933 of exposing for sale 13 packages of goods the true net weights of which were not as shown on the packages enclosing the goods. The defendant, represented by Mr C. S. Thomas, pleaded guilty. Mr E. F. Smith, prosecuting for the Department of Labour, said when an inspector visited the shop he found after weighing a quantity of packages of' goods that 13 were underweight ana 12 overweight. It appeared that the scales had recently been painted, and, apparently, certain of the parts had become sticky and had not been working properly. Actually, in the packages weighed there was 94 drams overweight, as against 44 drams underweight. The defendant, on tjie recommendation of the department, had since bought more modern scales. A nominal penalty only was asked for. Mr Thomas said the scales, which, when the business was’taken over, had been approved by the department, had been checked and proved each year. The defendant had lost more than he had gained, and there could be no suggestion of dishonesty. Asking for a nominal penalty only, Mr Thomas said that the defendant, who had, to prevent any further trouble, bought new scales which had cost £3O, had not been convicted before.
