MAGISTRATES COURT

THURSDAY (Before Mr E. C. Levvey, S.M.) CHARGES OF DESERTION John Sydney Pickard, alias John Sydney Evans, a seaman, aged 17, pleaded guilty to a charge of desertion from a ship. • Senior-Sergeant J. Bickerdike said the accused left the ship with eight ' others of the crew, and to enable the ship to leave on schedule an aeroplane had to be chartered from Weilington to bring more men to make up the crew. Pickard had since changed his name. The accused was convicted and ordered to come up for sentence if called on within 12 months, and to pay costs. , i Charles Dillon, steward, aged 35, pleaded not guilty to a charge of de- 1 section from a ship at Lyttelton. Dillon said he went away for a week-end,.- thinking his ship was to sail on the Monday or Tuesday of the next week. When he returned on the Monday he found much to his surprise that the ship had already sailed. He was now stranded in a strange country without clothes or money, and with', the prospect of a bad discharge. The case was stood down till to-day to enable inquiries to be made about help and work for the accused.

REMANDED Daniel William Charles Everest, labourer, aged 20, was remanded to March 19 on a charge of stealing on March 6 a cycle, valued at £7, the property of some person unknown. Stephen Gorinski (Mr C. V. Lester), a carpenter, aged 24, was remanded to March 19 on a charge of indecent assault on a female. Senior-Detective H. Nuttall, asking for the remand, said 12 other similar charges would be heard against Gorinski.

TWO CHARGES William Pengelly, labourer, aged 21. pleaded guilty to two charges—the theft on February 11 of a cycle, valued at £lO, the property cf Sylvia Woodham 1 and (2) that on February 27 he did unlawfully and without colour of right but not so as to be guilty of theft as defined by the Crimes Act convert to his own use a cycle, valued at £ll ss, the property of Phyllis Newman. „ _ Senior-Detective H. Nuttall said Pengelly had taken the first cycle from outside a dance hall in the early hours of the morning and had removed the front wheel and taken it home. He ha I been caught wheeling the second cycle which had been taken from High street at the Christchurch railway station. The accused had previously been before the Court, and on the last occasion had been sentenced to Borstal detention for two years on a charge of being idle and disorderly. Pengelly on the first charge was convicted and ordered to come up for sentence if called on within three years, and on the second he was convicted, and discharged. A condition was made that Pengelly, who had been called some time ago for military service, be handed over to the military authorities for immediate entry into camp. DEFERRED SENTENCE James Edward Cagney was convicted and ordered to come up for sentence if called on within 12 months and ordered to pay costs on a charge (to which he pleaded guilty) of converting to his own use but not so as to be guilty of theft a cycle, valued: at £9, the property of Bernard Carr* Senior-Sergeant Bickerdike said the accused had taken the cycle from outside a dance hall. K.; Moloney).. labourer, aged 36, pleaded; guilty to a charge of stealing at Wellington on September 24 an valued at £7 17s 6d, the property ■of Robert Stewart. : ■ The accused was a married, man, separated from hi&: wife, was at present serving aUterm ment for .defaulting in payments of maintenance, Senidr-DetectiveiNilttall said. He had taken the overcoat from: the Complainant, and had later pawned it in Auckland. He had a,record;qf convictions. . '■ Mahoney was sentenced to imprisonment for three months. BREACH OF BLACK-OUT ■ William Nome (Mr A. F. Wright), a medical student, was convicted and ordered to pay costs on a charge of leaving lights burning on his motor-car during the black-out on February 18. PROHIBITED PHOTOGRAPH Joan May McFarlane pleaded not guilty to ; charge of taking a photograph of docks at Lyttelton without a permit. She was convicted and ordered to pay costs only. LICENSING BREACH Hugh Campbell Steel (Mr J. D. Sargent), licensee of the Star and Garter Hotel, was fined £5 and ordered to pay coats for selling liquor after hours, CIVIL COURT (Before Mr F. F. Reid, S.M.) JUDGMENTS BY DEFAULT Judgment for plaintiff by default was given in each of the following civil claims:—Blackwell Motors, Ltd. v. R. Langley, £l3 13s Id; John Burt Corbett and William James Dixon (trustees in estate of Francis David Kesteven) v. Jim Joe Lee, £2O; Commissioner of Taxes v. Cyril Willis Brewer, £23 Os lid; Irish Linen Spinning and Weaving Company, Ltd. v. N. G. Ives, £2 2s 9d; same v. G. M. Moore, £2 3s 3d. JUDGMENT SUMMONS Albert Walter Elwood was ordered to pay Messrs McKenzie and Willis, Ltd., £2 12s 3d forthwith, in default imprisonment for four days. ORDER FOR POSSESSION An order for possession on or before April 10 was granted J. E. Rountree against A. D.,Crawford. The issue of a warrant will be suspended to April 10 as long as current rent is paid each week. JUDGMENT FOR PLAINTIFF Judgment for-plaintiff (T. G. Anderson) was given againstlw. Parker for possession of a quantity' of books and costs (£1 18s). Judgment for £1 was allowed plaintiff should the books not be returned. 1
