Young, S.M.) CLAIM FOR POSSESSION Herbert Downes, a pensioner, of Sumner,, claimed from Harry Codyre, a railway employee, of Swannanoa, possession of a whippet pup, known as Black Surprise, which had been *in the possession of the defendant since November, 1940. If possession could not be given, the value of the dog, which was placed at £lO, was claimed. Mr P. H. T. Alpers appeared for Downes.

Downes, in evidence, said that his wife had made an arrangement with Codyre to race the dog in partnership. However, money and trophies won by the dog had not been given to Downes, and, later, without authority, Codyre had sold the dog. .Codyre stdted that, because of services rendered, the dog had been given to him as a straight-out gift. The Magistrate said that he was satisfied from the evidence that Downes had an interest in the dog, and judgment was given for plaintiff for £5 and costs.
