DUNEDIN RATEPAYER’S ACTION (FBE33 ASSOCIATION TBLBGBAM.) DUNEDIN, December 12. A judgment important to a ratepayer on a city property was given by Mr Justice Kennedy in a case in which James William Young, hotelkeeper, sought an order as to what principles Should be applied by the city valuer m determining rateable value under the Rating Act 1925. The plaintiff had stated that he believed that the valuer, in determining the rent at winch the property would be let, and before deducting the 20 per cent, provided under the Rating Act had added thereto the rates which the plaintiff was liable to pay to the defendant corporation, and he objected to the valuation. His Honour, in a long judgment held that there was no warrant in the statute for the valuer -to take the rent which would be paid by a hypothetical tenant and add it to the rates payable, by the. tenant as occupier, then return..' mg such an increased sum . as the <annual-value of the premises.
