THURSDAY (Before Mr E. C. Levvey, S.M.) FALSE DECLARATIONS

Charges of receiving excess sustenance payments by making false declarations to the Employment Division of the Department of Labour were brought against James Alexander Campbell (Mr J. K. Moloney) and Henry Mehan Easton. Each was convicted and ordered to come up for sentence if called on in two years, and ordered to refund the money obtained bv the false declarations as directed by the Probation Officer. The amount m Easton’s case was £3 10s and in Campbell’s it was £7 Is 3d.

TRESPASS ON RACECOURSE Frederick Charles Price, charged with trespassing on the New Brighton racecourse on a race day when he was prohibited from attending race meetings, was fined £5 and ordered to pay costs. Default was fixed at 30 days imprisonment.

CHARGE DISMISSED A charge of a breach of a prohibition order brought against Romulus Walter Lilley (Mr W. R. Lascelles) was dismissed, defendant stating m evidence that he had been drinking “home-brew.” ON LICENSED PREMISES Margaret Dunne and George Scott, charged with being unlawfully on the licensed premises of the New Wellington Hotel after hours, were each fined 20s and ordered to pay costs. SUNDAY TRADING

Avery Dale, charged with Sunday trading, was fined 20s and ordered to pay costs.

REMANDED for sentence

Mrs Mavis Hill (Mr J. T. Watts), aged 26, pleaded guilty to two charges of theft and was remanded for sentence, on bail, till November 15. The first charge was that she stole a quantity of jewellery and clothing to the value of £l7 13s 6d, the property of Elisabeth Florence Hussey, and the second that she stole crockery valued at £1 12s 6d, the property of Beatrice Jane Wallis.

CHARGES OF ASSAULT David Robert Clarke, charged with assaulting Edward Thomas Ebborn and his son, B. H. Ebborn, was fined £2 on one charge and £1 on a second. Similar charges against John George Clarke (Mr L. W. Gee) were dismissed. It was stated in evidence - that the trouble between the Clarke brothers and the Ebborns had arisen after a fight amongst dogs, one owned by the Ebborns and three by the Clarkes.

COMMITTED FOR TRIAL An allegation that he had called on his landlord to pay his rent and secured. a receipt without _ paying the money owed was made in a charge against Norman Henry Thomas (Mr C. V. Quigley). Thomas was charged with stealing from Henry Wealleans a receipt form for £5, the form purporting to be an acknowledgement that Wealleans had received £5 from Thomas. ~ , , Wealleans said m evidence that he had summoned Thomas for his rent Thomas called at his house, and was carrying a savings bank book witn some notes protruding from it- Thomas said he had come to pay the £o owing. Witness wrote out a receipt form, and Thomas said a 2d stamp was needed. Witness produced two Id stamps, but accused said that they would not do. Accused took the receipt and said he would take it to a neighbour for witnessing and to get a 2d stamp. Accused also asked witness to put his rent book in order While witness was looking at the rent book Thomas walked out, and witness discovered that accused had taken the receipt with him. Thomas paid him no money, witness said. Corroborative evidence was given by Mrs Constance and Herbert Stanley Faulkner. Constable O. D. Wilkes, who interviewed the accused said Thomas had persisted that he had paid the money and denied that, at the time, any mention had been made of stamping and witnessing the receipt. Thomas pleaded not guilty and was committed for trial at the next sessions of the Supreme Court, Bail was fixed at £SO, with one surety of £SO, and the accused was ordered to report daily to the police.
