DEPRECIATION ON HOUSE
INCOME TAX DECISION | QUESTIONED . COMMISSIONER UPHELD BY x COURT CrBESa ASSOCIATION TELEGRAM. I WELLINGTON, September 9. Judgment in favour of the Commissioner of Taxes has been 'given by Mr Justice Smith in the case in which the assessment of the Commissioner of Taxes was appealed against by Cyril Paul Hunter and Thomas Percy Hunter in respect of his disallowance of depreciation on a dwelling-house on Sir George Hunter’s estate at Porangahau. His Honour said that the test to be applied was whether there had been, in the business sense, something more than a temporary cessation <r the actual use of the house for the purpose of producing an assessable income, as the bouse had not been used since Sir George’s death in 1930 to house anyone engaged in sheep-farming operations. His Honour thought that there was evidence, from which the Commissioner drew the conclusion he did, that the trustees were not holding the house during the years ended June 30, 1935, and June 30. 1936, for the purpose of using it for the farming operations they were carrying on.
