JUDGMENT FOR THE DEFENDANT
* CLAIM BY TWO TRANSPORT COMPANIES (rs,«ss assochtiok telegram.) WELLINGTON, August. G. Judgment was given for the defendant to-day by the Chief Justice (the Ri. Hon. Sir Michael Myers) in the enses in which Newman Brothers, Ltd., Nelson, and Jenkins Motor Ser- | vices, Ltd., sought to quash the decision of the Central Licensing Authority in renewing the licenses of S.O.S. Motors. i The case was heard on July 17 and! 18. S.O.S. Motors, Ltd. (Wanganui), in liquidation, was granted the renewal of a license on June 3 last by the Central Licensing Authority, after the hearing at New Plymouth on June 6 and 7. Newman Brothers, Ltd.. of Nelson ("Mr R. E. Harding), and Jenkins Motor Services, Ltd. (.Mr C. C. Marsack), Masterton, applied at the same time for the license given to S.O.S. Motors, but; their applications were refused, and the renewal to S.O.S. Motors was granted. Newman Brothers and Jenkins Motor Services, acting as separate plaintiffs, then applied for writs of certiorari and man* damus against J. A C. Album, as the Central Licensing .Authority. The general grounds of the applications, which were heard together, were that the licensing authority did not give due consideration to the position of the Transport Licensing Act, and gave a certain amount of weight to considerations not mentioned in the act
