♦ CLAIM AGAINST ASSURANCE COMPANY (MES3 A9SOCIATJOK TELEGKAIt.) WELLINGTON, May 31. Mr E. Page, S.M., gave judgment for the Wellington Express Company against the Phoenix Assurance Company on a claim for goods which were burned on a lorry in September last when en route to Masterton. Thinking that the value form had to be in within 24 hours when the Assurance Company asked for particulars, the manager of the Express Company filled a form in on meagre information at £B9, but the real value was subsequently proved to be £172 17s 6d. For this the owner of the goods got judgment against the Express Company, but the Assurance Company refused to pay except on the form estimate of £B9. The magistrate said that the declaration of tfie value made subsequent to the loss did not have the effect of converting the floating policy into a valued one.
