ACCIDENT ON RACECOURSE. (PRESS ASSOCIATION TILJSG.RAM ) HOKITIKA, June 9. At a special sitting of the Supreme Court to-day his Honour Mr Justice Blair presiding, James Edwin Searle, of Mananui, claimed £1029 damages and compensation for the partial loss of the sight of his right eye caused by being struck by a tape from the starting barrier at the Westland races i in December, 1931. After a hearing lasting all day his Honour said that negligence by the defendant, the Westland Racing Club, was not proved. Even if negligence had been proved the onus was on the plaintiff who, with others at the starting post, was warned by the starter of the danger, and told to keep clear of the starting apparatus. Judgment was given for the defendant club with costa.
