CHARITABLE BEQUEST.
CHANGE OF OBJECT APPROVED. [THE FBESS Special SerrlM,] * DUNEDIN, September 19. Decision was given by his Honour Mr Justice Kennedy -in the Supreme Court this morning in the case. in which application was ipade to change the object •of a trust left by the late Robert Glendining to Knox Church, so that an organ might be providedinstead of a peal of bells. His Honour held that. it. was that the original - purpose of' quest, namely, to turnisb :a. peal nfr; bells for. the. church, was a charitable, purpose .within , the meaning of -the : Act: So, likewise, was. tho^fiirnishing--of .a church with an. organ.. Proceeding, his Honour said: "There - is no doubt that the; trust fvjnd is at. present inadequate: to provide a peal, of - bells, and-1 have cpme -to the conclusion on the evidehce that although ; this is not a clear case-it is inexpedient ' to. carry out ;the. original. fiharitr.' able purpose*. The Cour.t of Knox Churchy Incorporated, expressly: undertook if the scheme .were approved to instnll an organ of the;value of iiotiess than - £4poO, tb place ah order for such an organ immediately - the .scheme was approved, " and to raise bysubsmption the said sum of £7OO or any. Larger sum .required in the event: of a more expensive organ being obtained within twelve months from, the "datoij on which the', scheme; was approved;.:. An order is made approving of the: scheme. It will contain as set". out. in : the draft order lodged reference to "these undertakings /by the -'peti- 1 tioner."
