As ft sequel to a fatal accident wfych oreuned on September 13th, trfiett a ear driven by Roy Rankin Wallace collided 1 with & baker's cart driven 1 by Andrew Mcßeath, who died na» day Us a Result of injuries received, * dril action was commenced la'.the Supreme Court before Mr Justice Kennedy* and n jury of twelve. Plaintiff Was Meßeath's widow, Margaret Mcßnsth, who sought to recover from Roy Rankin Wallace (the driver) and Fleming and Co., Ltd. (owners of the car concerned in the accident) the sam of £2500. as damages in respect of the death of her husband. The jury returned a Verdict for £1250 damages, £750 to go to the widow, ami £SOO to be divided equally among the children. " . Mr J. S. Sinclair (for Fleming and Company) moved for a tton-Btlit, While Mr w. Tait (for plaintiff) moved that judgment be entered in terms 6f tho jury's finding. , . His Honour reserved his decision.
