GUILTY OF ARSON.
LEAVE TO APPEAL REFUSED.
[THE PKESS Special Service.] AUCKLAND, November 13. Leave to apply to the Court of Appeal for a.new trial in the case of Francis James, CarrolJ, one of the two expolicemen convicted on a charge of arson in connexion with the explosion and fire on August. 29th at Carroll's shop, in Napier, street; was refused by Mr Justice, Smith in the Supreme Court. Carroll and Sydney Francis Waters were sentenced last week to three years' imprisonment and two years' reformative detention. "In my view the only possible conclusion from the facts is that Carroll intended the destruction of his leasehold premises and their contents by fire," his Honour said. "In carrying out that intention he received Waters and Tate into his shop on the Tuesday evening and permitted them to take away-goods which could only be regarded as a consideration for the destruction of the premises. He is therefore clearly a party to the crime of arson in that by a transfer of goods he induce?, another person to commit an offence."
