Unusual features marked the case heard in the Hamilton Supreme Court last week in-which one trustee petitioned tire Court to remove himself or his co-trustee from the Herbert Smith trust. Mr F. A. de la Mare, one ot the, trustees, appeared as a barrister to argue against the case presented by Mr M S. Johnson on behalf of the petitioner, Mr C. 13. Smith, When Mr Sir'th liad given evidence, Mr de la Mare cross-examined him and Mr Johnson expressed a desire to examine I de la Mare. Mr Justice Herdman expressed disapproval of Mr de la Mare's action in appearing both as counsel and a-party to the case, and said it would have .been .much better had Mr de' l*i Mare engaged someone else to argue the case for him.
