ACTION FOR DAMAGES FAILS. {mess ASSOCIATION TELEGRAM.) WELLINGTON, March 10. The hearing of the claim of William George Collins for £607 damages from Dr. Herbert Charles Faulke on the grounds of defendant's alleged negligence in the extraction of a tooth, thereby breaking plaintiff's jaw and causing septic poisoning, was concluded to-day in the Supreme Court before Mr Justice MacGregor. His Honour found that the doctor was not negligent, but that plaintiff was' himself negligent in not following out defendant's instructions. Although unusual, the breaking of the jaw was always liable to accompany the extraction of teeth. Sepsis, his Honour said, was in the tooth and the jaw at the time of the extraction. Judgment was given for defendant, who did not press for the costs of the action.
