S.S. CYGNET.
PETITION TO WIND UP COMPANY In the Supreme Court yesterday, his Honour Mr Justice Sim reserved his judgment in the petition to wind up Cygnet, Ltd. The petition was made by J. J. Nivcn and Co., creditor of Cygnet, Ltd., for £1354,. cost of repairs to the s.s. Cygnet. Mr W. J. Hunter appeared for J. .T. Niveh and Co., and Mr J. H. Upliam, with him Mr E. Twyneharo, for Cygnet, Ltd. . When the case was first called on Tuesday, Mr TJpham raised a preliminary objection that Mr Cooper, manager of J. J. Niven and Co., who signed the petition, had no authority to do -so, aud that the petition did not conform to the rules of the Court. Evidence was given yesterday by Robert Edward Russell, of Wellington, a director and secretary of Niven and Co., who said that Cooper had authority to sign the petition. The seal was not affixed to the petition because it was necessary to affix it in the presence of two directors, and at the time only one was available.
