MAGISTERIAL. TI'ESDAY. Jlefort! Mr Wwern Wilson. K.M7) DJIUKKISNNKSS. A first, offender, who had been hailed out. of the iock-'.ip, was convicted and tilled lUs, in default, 2-1 hours' imprisonment. MAIXTEXANCE. Ellen Tin net* (Mr W. F. Tracy) proceeded against, her husband, 'William Arthur Turner (Mr M. J. Burns) for Reparation, guardianship, -mid maintenance orders on tho ground of failure to maintain her .and her infant child. The orders were made and maintenance was fived at £3 a, week. Turner was also ordered' to pay £,">(> as past maintenance and costs, and he was ordered to frivc security by deposit or bond to the. Public Trustee in one surety of £l5O within 48 hours. Charlotto Ann Bailey (Mr W. F. Tracy), who had to be '-assisted into the Court, and who was 'provided with -a chair during the hearing of the evidence because of her weakness brought abou't by ill-health, asked liis Worship to make a maintenance order against, her husband, Charles Bailey, nii architect (Mr S. E. McCarthy) oil tho ground that he 'ha-d failed to supply her with adequa.to maintenance. The order was made and maintenance fixed at £3 a week. The caso was rather an unusual one. Tho ".videnco disclosed tho fact that the husband had been committed to a mental hospital, but that he had been reloaded a short time after his committal. Ho had a fair amount of property in and about the city, and has made a will providing for an .annuity of £l5O a. year for his wife. Bailey was iivinij in Oxford terrace, and he believed his \vife was living at Tui Tapu, but he had not lived with her since. Oct-ober. As a result of havin<» been committed to a mental hospital, ho alleged that ho could not pr?t. work. Archibald Lyon Denniston was convicted and sentenced to 14 days' imprisonment in tho Mount Ede i gaol for disobedience of a maintenance order, the warrant to be suspended for seven days and tho defendant ordered, to bo released on payment of £lO. Louisa Corbett (Mr Freeman) asked for a maintenance order to be mado against her husband, Michael John Corbett (Mr J. B. Batchclor) in Tesnect of herself and her fTiree children. She also asked his Worship to make separation and guardianship' orders. After hearing the evidence the Magistrate dismissed tho case. Mary Agnes Sinclair (Mr G-. .A. G-. Connal) . asked for separation and maintenance orders to be made against her husband. Donald Sinclair, on the ground that he had failed to maintain her. The orders -were made and maintenance fixed at £2 a week. ■Defendant was also ordered to pay _ past maintenance, amounting to £SO, at instalments of 10s a week.

WELLINGTON, March 31: The Court of Appeal, to-day hoard ..an appeal from the decision of the Chief Justice, Sir Robert Stout, ill granting a new trial in James Lang, Wellington, against tli© New Zealand Insurance Co. The action came on for hearing in December, 1928, before the late Mr Justice Salmond and a special jury. The case for the plaintiff was that he had insured his stock-in-trade for £750 on December 16th, 1922. and received a cover nots for 21 days. 'lwo days after the co i tract was signed, on December 19th, 1322, a lire destroyed the stock, and the insurance comiany refused to pay out on the polie<?, on the ground that the plaintiff had made material misdescriptions and misreW'Sßntations. and the contract of insurance was {herefore void. The jury in answer to a question put to it, found that plaintiff was the owner of the goods, that he did not procure the contract by misrepresents e their price, and that there was no non-disclosure of material facta bv him. The goods were assessed by the jury at £IO9O 7e 7d, and judgment was given for plaintiff in . the amount claimed, and defendant company applied for a new trial on the ground that the verdict was aeainst iHo weight of evidence.
