CHRISTCHURCH SUBDIVISIONS.
CASE BEFORE APPEAL COURT. (PBIISS ABSOCIATI9H TMJSOSAM.) WELLINGTON, March 20. The Full Court was engaged this afternoon in hearing argument in the cases of Robert Landell Sannders, of Christchureh, solicitor, and the Church Property Trustees against the District Land Registrar of Canterbury. Both cases arise from the refusal of the District Land Begistrar to register transfers on the ground that by virtue of Section 335 of tho Municipal Corporations Act, 1920, the consent of the Christchureh City Council is required. In Saunders's case the sale is admitted by the District Land Begistrar not to constitute a subdivision within the meaning of Seetion 117 of the Public Works Act, 1908, but ho contends that the sale is a subdivision -within the meaning of Section -335. In the case of the Church Property Trustees, the District Land Begistrar has taken up the same attitude regarding conveyances to the Christehnrch Drainage Board and to Canterbury College, and has refused to register until the plan approved by the Council, under Section 335, has been deposited. Decision was reserved. The counsel engaged were Mr A. Fair for the District Land Registrar, and Mr H. D. Andrews for the Church Property Trustees. Mr Saunders appeared in person, and Mr T. F. Martin watched the case on behalf of the Christchureh City Council.
