The High Court has commenced the hearing of an appeal against the verdict in the case Captain Spain versus the TJnion Steamship Company, Ltd. The appeal is on various grounds, including one that the judge was in error in finding that the stranding of the Karitane was due to Captain Spain's personal carelessness and negligence . [Captain ".Bayer Spain, maater mariner, claimed £63 Iris from the Union Steam Ship Company in connexion with the wreck of the Karitane. The amount claimed was for expenses! incurred by him at the Marine Court enquiry, when he gave evidence in the company's interests. The captain proceeded against the company for the recovery of his expenses, the case resulting in a v«rdict for the company. Captain Spain appealed to the High Court, which ordered a re-hearing. The defendant company objected to the judge on the ground that he had already given a verdict on the same set of facts in the Marine Court. The case was then re-listed to come before Mr Justice Scholes. The v costs now greatly exceed the amount in dispute.]
