* SEQUEL TO MOTOR FATALITY. (PEISS ABSOCIATIOS TKLXdBAX.) AUCKLAND, July 12, A charge of manslaughter- arising from a' motor-car fatality on the Great Korth road on' the evening of May 9th, was heard at the Police Court today. John Leonard Lambert Smith, a young man,, the driver of the car, was charged that by omission to perform a legal duty, he did kill Maurice 8 years, thereby committing manslaughter. ' The prosecution contended that the accused was on the wrong side of the road, that he did not sound his horn,: and that he did not exercise sufficient precautions when he saw the boy and his companion, a girl aged 10 years, crossing the street. The accused said he was on the right side of the road, that he reduced his. speed when he saw the children to six miles an hour, and that-he swerved to the right to avoid the boy. Smith, who pleaded not guilty, reserved his defence, and was committed for trial. -
