CHARGE AGAINST W. WHELAN-

Charges of having' carried on the business of a bookmaker at Christchurch on December 16th la«t, were preferred against William,Whelan (Mr C. S. Thomas) at the Magistrate's Court yestenSiy, before Mr S. E. Mc* Carthy, S.M,

Mr A. T. Donnelly, acting-Crown Prosecutor, appeared for the Crown. Accused elected, to be tried by jury. Charles Carlson, bush-faller, at Kai-tieke,-called by : the prosecution said that in December., 1920J, he made a bet on the Auckland Cup, by -sending a pound in a letter to >V". Whelan, Christchurch. The befc was a double on First Salute in the Auckland Cup and Rossini in the Railway Handicap. ' He received the receipt, produced, in return dated December 16th. 1920. He asked for no particular price for the double. He had made other bets with Whelan at Christchurch, and had received correspondence in the form of race cards and double cards from him. The letter he sent to Whelan was addressed to the Post Office, Christchurch. Witness had done all his betting by letter, and had never seen Whelan. On the New Zealand Cup he had- a bet ■ with" Whelan, and thought he had jbout four bets altogether with him. He had never made a winning bet. Mr Donnelly said that was the only evidence he > proposed to call in the meanwhile. There were a number of other witneses. and probably the same questions would be raised in the case as had been raised in the Whitta case, the appeal in connexion with which would probably be decided in about ten days. It would be best to let the case stand over until the Court of Appeal had given its decision in that case. An adjournment was .made until the 27th inst., at 10- a.m., accused being admitted to bail in his own recognisances of £SOO. ' ,
