Captain Hickey stated that the defendants were called out for a parade one morning. They marched to the tram terminus at North-East Valley where, in order to give them a rest, they were dismissed and told to fall in again in about ten minutes time. The defendants immediately got on board a tramcar and went home. They were told to "come off" the car* and fall in, but they declined. Mr Macgregor, counsel for the defence, said that on the date in question tho young fellows complied with what was known as tho Blue Standing Orders issued, to them, which notified them that they must atte&d another of the parades they had been attending for months past, viz., parades of 1J hours. When they stopped for tho rest that time had expired, and they Appealed to tho captain, who told them it was a half-day parade. That was tho first intimation of tho half-day parade they had received, and they, told the captain so. Counsel submitted that no offence was disclosed, and tho case ought not to have been brought. Mr Bartholomew, S.M., reserved judgment.
