At too nearing. of the caso, a question was raised a. to wnether service of citation on a husband was vaud, m view of a decision which his had given in the caso of Elizabeth, Countess de Uuasquet Jamps versus Henry Benvin, Duke of Mecklenburgtscliwerin, on February 16th last.In that case the citation was served on the Duke abroad, and his Lordship c_.rae to tne conclusion that the Court had no power to serve tho citation ana petition upon tho respondent. Mc pointed out that the respondent was not domiciled in this country, was not resident here when tho suit began, and had never resided here. In the course of his reserved judgment, tho President -aid the practice had not been uniform, and the authorities were doubtful. In order that there should be no doubt with regard to the service in such cases, he proposed the following two new rules: — Rule 221. In a suit for restitution of conjugal rights, when it is stated in the petition, cither that tho parties to such suit were domiciled in England at the time of tho institution thereof, or that they had a.matrimonial homo in England at the date when their cohabitation ceased, or that they were both resident in England at the tune of the institution of the suit, the petition and citf-tion may be served either within or without his Majesty s dominions. . . Rule 222. When a suit for. restitution of conjugal rights has been duly instituted, and a decree is mado therein, such decree may be served either within or -without his Majesty s dominions.
