At. id. \\ ukio, a member of the Uhakune fiorough Council, applied for a Avrit of injunction restraining the Mayor and o.ner members ot the Council trom preventing him from attending meetings of tne Council on Alarch 17th, or other meetings, and exercising his lawlul rights _u» councillor. He also asked mat cielonuants Le ordered to pay the costs. _ The affidavits set out tnat the Council on February 2'Srd passed a resolution suspending plaintiff lor one meeting pending his apology for charge, made against tno Mayor, j Plaintiff Was not present when the resolution was passed, and was not notified it was to be brought down. Plaintiff attended a subsequent meeting, but was not allowed to object to the confirmation of the minutes, and the Aiayor (Air T. H. Kiely) also refused to allow him to sneaK or vote on any matter before the meeting. Plaintiff refused to withdraw, and the meeting 'was adjourned. Another meeting was held next day, and at the request of the..Mayor, plaintiff was removed by a policeman. Defendants thereupon passed 'another resolution suspending him for a further period of fourteen days. Defendants, in their statement, relied for lega.ity of their action upon the borough by-laws and the standing orders and procedure of the House of Representatives. The Court reserved its decision.
