REFUSING DUTY
A FIREMAN FINED. At the Lytteiton Magistrate's Court yesterday, before Mr W. C. Cleary, J.P. Edward Phipps, a fireman on tho n.a. Petone, was charged with having, on the Bth inst., on the high seas, refused the lawful commands of Captain Cowan to keep watch in the stokehold. Hβ pleaded not guilty. Captain Cowan stated that shortly after leaving Lytteiton on the date mentioned, the chief engineer reported to him that Phipps was lying in his hunk and refused to take his watch. On witness going to the firemen's quarters Phipps still refused to turn to. Accused signed on the vessel on February 17th, and had on a previous occasion behaved in the same way. Coiioborativ-! evidence was given l>y tho chief engineer, who stated that Phipps at the tine of the offence was under the influence of liquor. The Bench said that it was clear a breach of the law had been committed. Accused, however, had been under the influence of drink, and under the circumstances a lenient view would be lnl:»n. lie world be fined 10s with costs 7s. in default seven days' imprisonment.
