Arthur William Rait stepped into tho dock at tho Magistrate's Court yesterday afternoon, before .Mr T. A. liBailey, S.M., charged with having, at Cunstehurch, on March 2"Jth, committed perjury in the _ testimony no gave on oath at the inquest touonng tae deatn of one William Aenucay. -ur Johnston appeared tor accused, ana 6uc-lnspeccor MeKinnon prosecuted. Tho words accused u_a alleged to have falsely sworn were: "My norso swerved and I passed the object—l vras about two yards from the object—l uicl not pull up to see what it was—l bad a job to manage my horse —1 swear 1 never struck deceased, and 1 am not run over him on the ground."
James Ashley stated t_at he and his son were walking along Manchester street, at about 7.i-o p.m., on March 24th. They were waikmg from tuo Now Brighton car towards the railway station. When near the Kaiapoi Woollen Companys building witness heard a loud crash. Ho saw a dark object on tho opposite side of the street. Be saw a hansom cab coming from the direction of the South Helt. immediately after the crash witness saw that the cab had passed the spot where tne dark object was. Witness went over, and saw the object. It was an old man who was being lifted on to tho footpath. The horse or wheel must have gone over the object witness saw. It would be untrue to say that tho horse had shied and did not strike tho object. George Ashley. Sergeant Stewart, and Sergeant Mathieson gave evidence in support of the charge, and accused, who pleaded not guilty, was committed for trial, bail beinz allowed, self ioU , and one surety of £100.
