SYDNEY GOVERNMENT HOUSE CASE.
JUDGMENT OF THE COURT,
(By Cable.—Press Association.—Copyright.) (Received March. 20fch, 9.20 p.m.) SYDNEY, March -'<•>. .Tho specially constituted Equity Tribunal delivered reserved judgment in connection with the alleged eviction of the Governor-General from Government Houso. The Court found that the Government of Now South Wales was moroly the custodinn of Government House for the Imperial authorities, and was nqt entitled to utiliso tho premises for other than the purposes for which it was originally set apart. An injunction u'as granted with costs against tho Government. Having regard to the relation of the Governor to the Crown, both as executive head of the Empiro and of New South Wales, the Court was of opinion that the proprietary right in the lands set apart before tho passing of the Constitution Statute for tho purpose of the Governor's residence did not, any more than lands sot apart for naval and military purposes, pass from tho Imperial to the New South Wales Government. Moreover, though the land might have been dispropriated from the purpose of a Governor's residenco and applied to a purely local purpose by the Executive Act without legislation, this could not be done by tho Governor acting on the solo advice of local Ministers, much less by tho Ministers themselves without his concurrece. By whatever means such change in the proprietary right might be effected, there should be some evidence of concurrence by the Imperial Government.
